Restrictions to rent increases

Looking to increase the rent? Recent changes to tenancy laws mean the rent cannot be increased within 12 months of the original tenancy agreement or the last rent increase. Even if the tenant mutually agrees to a rent increase, this duration between rent increases still applies. You should also be aware that SACAT can deem some rent increases to be excessive.

Sub-letting cannot be unreasonably refused

If you have a tenant who wants to sub-let the property, there’s a good chance you won’t be able to refuse their request under recently implemented tenancy laws. Landlords are also not allowed to ask tenants for a fee to secure their consent. However, the head tenant is still responsible for the rent, the behaviour of people living in the property and informing the landlord about repairs.

Limits on routine inspections

Checking up on your property’s condition is reasonable, but there are limits on how often you can conduct a routine inspection. From July 1, 2024, this limit is capped at four inspections per year, with each inspection requiring 7 to 28 days’ notice. The time taken to conduct an inspection is also limited, with two hours set as the maximum duration.

Tenants with pets

Tenants now have more rights when moving into your property with their pets. Landlords can set reasonable conditions, such as requiring a professional carpet cleaning at the end of the lease. However, if the tenant agrees to these conditions, a landlord is not allowed to unreasonably refuse their application to house their pet at the rental property.
